In Maryland, a disclosure statement is required by statute. Most realtors, when you sign the Listing Agreement in Maryland, will have you fill out a Disclosure Statement that talks about condition of the property. It includes things like plumbing, runoff, things of that sort. However, there’s an alternative. The statue allows for a Waiver of the Disclosure and you sign a waiver. I rarely allow my sellers to sign a Disclosure Agreement. That’s what an inspection is for. Make sure you have all documents reviewed by your real estate attorney, especially the Listing Agreement and all the attachments.
