First there are two types of powers of attorneys. One, which is effective upon disability. And another, which is effective when you immediately give it or effective upon a specific event. We recommend in my shop that it’s effective upon your disability. And then that person becomes your power of attorney and if it’s drawn properly, he can do anything that you could do, were you able to do to. And so there is no need for a guardianship proceeding whatsoever. Also, properly drawn powers of attorney deal with not only money but they deal with the appointment of a person to be your guardian should it become necessary.
